Below are the terms and restrictions that apply to Standard Days, Premium Days, and Proclamation Days. Please carefully review all of the terms and restrictions before applying. The application fees are non-refundable and you may not cancel or edit an application once submitted.
When in doubt, contact us at info@NationalDayArchives.com prior to applying for a National Day.
I. Non-Refundable
All payments are considered non-refundable application/processing fees. Even if the listing is not accepted or later removed because it does not meet our terms or restrictions, there is no refund. For instance, if there is any adult or otherwise restricted content or the day already exists, your entry will be rejected without a refund or later removed without refund.
II. The National Day Already Exists
Cannot Duplicate Existing Days. If the National Day already exists, you cannot create the same National Day, even if it occurs on a different date. For instance, if there exists a National XYZ Day on December 1, you cannot apply for same name on a different day. You must pick a sufficient variation of the day to avoid confusion, such as National See a Play in XYZ Day or National Share Why You Love XYZ Day. When in doubt, contact us in advance of applying.
For personal names under the Proclamation Day listing, it is permissible to have different National Days for persons with the same name. For instance, if John Jones in Atlanta created a National Day named National John Jones Day for April 1, another John Jones could create a National Day under the Proclamation Day listing with the same name on the same or a different day.
III. Restricted Content
There are two main types of restricted content: (1) adult/inappropriate content, and (2) trademark/copyright violation. Please select only names of days and suggest content describing the day that complies with all of these restrictions. If any part of your proposed name or content contains a single violation, your entire application or listing may be rejected or later removed without a refund.
1. Adult or Inappropriate Content
National Day Archives does not allow any adult, controversial, or provocative content in the name of the day or description of the day. We reserve the sole and subjective right to reject or remove any National Day containing any adult themes (sexual or graphic) or any proposed name or content that might be viewed as unlawful, defamatory, embarrassing to others, slanderous, offensive, harassing, hateful, prejudicial, violent, controversial, or insensitive.
2. Trademark or Copyright Violations
The proposed National Day or suggested content cannot contain names or content protected by trademarks or copyrights. For instance, you cannot include in the title of the National Day any names of celebrities, movies, or trademarked products. For instance, don’t apply for National XYZ Fan Day for your favorite professional sports team, movie star, or product. Only the trademark owner can use its name for commercial uses.
If we are notified by a person or entity claiming that the name of the National Day itself, the description of the day, any content, or you being listed as a sponsor violates a trademark or copyright, we have the sole and subjective discretion to remove the day, change the name, change the description or content, or remove you as a sponsor. We may do one or all of these things without notifying you, and without seeking your permission or consent. We also will not refund your fees even if we take one of these actions. We may do one or all of these things without first litigating or obtaining a ruling on the validity of the assertion or claim. We may choose to act in order to avoid litigation costs. We are not liable for any damage, loss, lost profits, or harm of any kind. Our liability, if any, is also limited to the amount of your application fee.
A special note regarding copyright: Because something appears on the Internet, such as an article or blog, you cannot simply copy the words of others. For instance, you cannot cut-and-paste something you read and use it as your proposed content. You must use your own words. The same is true for pictures. You cannot simply copy a picture from the Internet and upload it to the National Day your are registering. Images are protected by copyright too.
IV. Suggesting Content for Webpages Linked to a National Day
No right to specific content on the webpage. If you apply for a listing that comes with a webpage (Standard or Premium), if it is accepted and does not violate content restrictions, we will create a dedicated webpage linked to the listing on the appropriate category section of the National Day Archives. We will list you on that webpage as the creator of the National Day. Although we invite you to suggest content for the webpage, such as why the day was created how to celebrate it, we are not obligated to use your suggestions.
Remember this is a National Day for everyone to celebrate. Thus, we have sole and subjective control over the content of the webpage listings on our website and have sole and subjective discretion in drafting the content for the description or other content associated with listing the National Day, including but not limited to describing the reason for the day or how to celebrate it.
We can also add links to other events or webpages relating to the topic, even potential competitors or other businesses. We will edit the webpage content from time to time, since the media and public are invited to review the days and join in the celebration and we strive to make the National Days relevant to the public. Your application fee does not entitle you to describe the day, why it was created, or ways to celebrate it, but we do welcome your ideas or suggestions.
If your day is accepted and does not violate any content restrictions, we will list you as the creator of the National Day. However, there are no refunds if you do not like the way we describe the National Day or if you object to any content or inclusion of other information or a listing of potential competitors. We also reserve the right to offer advertising on the website and individual webpages, including the National Day webpage associated with you.
V. No Editing After You Apply
No cancelation and no editing (editing fees apply). You cannot cancel or edit an application once it has been submitted. Again, the application fees and editing fees are non-refundable. The current editing fee is $99 per each request and is subject to increase without notice.
In addition, if you do contact us to request a change, there will be an additional processing fee for each request to cancelation or editing once the application is submitted. Again, we have the sole and subjective discretion to describe the day or other content as indicated above. Therefore, even if you suggest an edit, not only was the original application or processing fee non-refundable, but the fee to request changes is non-refundable processing fee even if the change is not made or accepted.
Even if you ask us to cancel a National Day, we may decide in our sole and subjective discretion to keep the National Day or change the date, but we will remove your name as the creator if requested, but without a refund.
If you want to remove your name as sponsor or suggest changes, you must use the same email address that you originally used to apply for the National Day and pay the editing fee, so we can confirm that you were the creator.
VI. Not Liable for Any Harm or Loss
Limited Liability. If we reject or remove your application or do not list you as the creator, even after the National Day had been posted on our website, we are not liable for any harm, loss, lost profits, or any form of damages you may claim to suffer as a result of not being listed as a sponsor or the rejection or removal of the National Day or you as the creator. Our liability is limited to the amount of the application fee.
